Chapter 91 & Industrial Owners

  • Land that is subject to Chapter 91 jurisdiction implies some form of public access to that land, even if it is privately owned.   Generally speaking, this regulation applies to tidelands or areas that were previously tidelands before interruptions from the built environment, such as dams.  Before the construction of Amelia Earhart Dam, the Malden River was subject to tidal changes and therefore under the Chapter 91 jurisdiction.
